As the Polisario Front and Morocco are competing in a legal war through the European institutions, the Court of Justice of the European Union has finally decided to annul the trade agreements on agricultural and fishing products between the Cherifian Kingdom and the EU.

The three judgments handed down by the Court of Justice on 4 October 2024, all concerning the Western Sahara, are of considerable importance. Not only because they appear to put an end to the legal controversies on the question of Western Sahara in European Union law, but also because they contain important contributions, some innovative, others clarifying, both on the Saharawi question and on certain questions of public international law (in particular the question of the presumed consent of a non-parties to the treaty) and European Union law (imperative international law as an element of Community supralegality).
